1. Winkels v. Riverside Health & Fitness Center

Petitioner brought forth a claim alleging that she sustained neck and back injuries as a result of her work activities teaching aerobics on October 9, 2000. Petitioner also alleged she was unable to resume her former job duties as a result of the accident. Respondent introduced witnesses who testified that Petitioner continued to engage in weight lifting and aerobic activity after the accident despite her allegation that she was unable to perform her job duties. The Arbitrator denied compensation and found that Petitioner did not sustain an accident at work. The Arbitrator found the testimony of the petitioner’s supervisor to be more compelling than Petitioner’s testimony.
